Liability & Participation

Flamenco dance classes, rehearsals and performances involve physical activity and carry inherent risks of injury. By participating, I acknowledge and voluntarily accept these risks and take responsibility for ensuring that I (or my child) is physically able to participate safely.

I agree to inform the teacher of any injury, medical condition or physical limitation that may affect safe participation.

Flamencollab, its teachers and representatives accept no responsibility for injuries arising from the ordinary and inherent risks associated with participation in dance classes, rehearsals, performances or other Flamencollab activities.

Students are responsible for their own personal belongings. Flamencollab, its teachers and representatives accept no responsibility for personal property that is lost, stolen or damaged while attending Flamencollab activities.

Important Consumer Law Notice

WARNING UNDER THE AUSTRALIAN CONSUMER LAW AND FAIR TRADING ACT 2012

If you sign this form, you will be agreeing that your rights to sue the supplier under the Australian Consumer Law and Fair Trading Act 2012 are excluded, restricted or modified in the way set out in this form, if you are killed or injured because the services provided were not in accordance with the statutory guarantees outlined below.

Under the Australian Consumer Law (Victoria), several statutory guarantees apply to the supply of certain goods and services. These guarantees mean that the supplier named on this form is required to ensure that the recreational services it supplies to you-

are rendered with due care and skill; and
are reasonably fit for any purpose which you, either expressly or by implication, make known to the supplier; and
might reasonably be expected to achieve any result you have made known to the supplier.

Under section 22 of the Australian Consumer Law and Fair Trading Act 2012, the exclusion of these statutory guarantees is brought to your attention by this form.

NOTE: The change to your rights, as set out in this form, does not apply if your death or injury is due to gross negligence on the supplier's part. Gross negligence, in relation to an act or omission, means doing the act or omitting to do an act with reckless disregard, with or without consciousness, for the consequences of the act or omission. See regulation 5 of the Australian Consumer Law and Fair Trading Regulations 2012 and section 22(3)(b) of the Australian Consumer Law and Fair Trading Act 2012.

Medical Attention

If Flamencollab reasonably believes that urgent medical attention is required, an ambulance or other emergency assistance may be contacted.

Any costs associated with medical or ambulance services are the responsibility of the student or, where the student is a minor, their parent or guardian.

Privacy

Personal information collected by Flamencollab is used for the administration and operation of the school and for communication with students and families.

Personal information will be kept secure and will not be sold, rented or traded to third parties.

Class Cancellations & Make-Up Classes

If a teacher is unavailable, Flamencollab will endeavour to arrange a suitable substitute teacher.

If a substitute cannot be arranged and a class must be cancelled, a make-up class will be scheduled where possible. If Flamencollab is unable to provide the class or a reasonable alternative, an appropriate credit or refund will be provided.

If a student misses a class included in their trimester fees, they may request to attend another suitable class within the same trimester as a make-up, subject to availability and appropriate level placement.

Missed classes cannot be carried over into another trimester and are otherwise forfeited.

Payment Policy

Trimester fees must be paid according to the dates and terms stated on the invoice. Students with overdue fees may be refused participation in classes until outstanding payments have been made or an alternative arrangement has been agreed with Flamencollab.

Students who select either an upfront trimester payment or a 3-part payment plan receive the applicable trimester discount and are committing to the full trimester.

The 3-part payment plan is a means of paying the full trimester fee in instalments. It is not a casual, week-to-week or trial payment arrangement. Once enrolled under a discounted trimester payment option, the full invoiced trimester fee remains payable if the student subsequently chooses to discontinue or does not attend the remaining classes.

Students who do not wish to commit to a full trimester may attend casually at the applicable casual rate, where available.

Casual class fees must be paid prior to attending each class by bank transfer or correct cash.

Fees are non-refundable for change of mind, withdrawal or missed classes, except where otherwise stated in these Terms & Conditions or where a refund or other remedy is required under Australian Consumer Law.

Media Release & Copyright

Choreography taught at Flamencollab remains the intellectual property of Flamencollab and/or the choreographer and must not be reproduced, taught or performed without permission.

Videos taken during classes or rehearsals may be shared with students for educational purposes and must not be published or distributed without permission from Flamencollab.

By participating in Flamencollab classes, rehearsals, performances and events, I grant permission for myself (or my minor child) to be photographed and filmed by Flamencollab and its photographers or videographers. I give

Flamencollab permission to use and publish these images and recordings for promotional, educational and archival purposes, including on its website, social media, advertising and other Flamencollab communications.

Where separate parental consent is required by law or by a performance venue, Flamencollab will seek this consent.

Annual Showcase

Participation in Flamencollab's annual mid-year showcase is optional.

Students who choose to participate are required to pay the applicable Show Fee and purchase or obtain the required costume/s for each number in which they perform. Costume requirements and costs vary between classes and choreography.

Students who do not meet the costume requirements for their class will be unable to participate in that performance number.

Show-related expenses are additional to regular class fees and are generally incurred during the lead-up to the showcase. Where available, payment arrangements for handmade costumes may be organised directly with our dressmaker.

Further information regarding participation, rehearsals, costumes, fees and performance requirements will be communicated during the school year.
